Welcome to Kandy Koated Kustoms. These Terms and Conditions ("Terms") govern your access to and use of the website located at kandykoatedkustoms.com (the "Site") and your purchase of any products from Kandy Koated Kustoms LLC ("Kandy Koated Kustoms," "we," "us," or "our"). By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site or place an order.

1. About Us

Kandy Koated Kustoms LLC is an Indiana limited liability company that sells polyester metal flake and related products for automotive, craft, and custom coating applications.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By placing an order you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Products, Descriptions, and Availability

We make every effort to display our products and their colors accurately. However, metal flake is a reflective material, and actual color, sparkle, and appearance can vary depending on your screen, lighting, base coat, clear coat, application method, and flake size. Color and finish shown on the Site are for reference only and are not guaranteed to match your final result.

All products are subject to availability. We reserve the right to limit quantities, discontinue any product, or correct errors in product descriptions or pricing at any time without prior notice. Flake sizes other than those displayed (for example, sizes other than .008) may be available upon request.

4. Pricing and Payment

All prices are listed in U.S. dollars and do not include shipping or applicable taxes unless otherwise stated. We reserve the right to change prices at any time before you place an order.

Payment is processed securely through Shopify and its third-party payment providers. By submitting an order, you authorize us (through our payment processor) to charge your selected payment method for the total order amount, including shipping and taxes. We do not store your full payment card details on our servers.

If a price is listed incorrectly due to a typographical or system error, we reserve the right to cancel any order placed at the incorrect price, even if the order has been confirmed.

5. Orders and Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept, decline, or cancel any order for any reason, including suspected fraud, errors in pricing or product information, or product unavailability. If we cancel an order after payment, we will issue a refund to your original payment method.

6. Shipping and Delivery

We ship to addresses within the United States. Shipping costs and estimated delivery times are calculated at checkout and depend on the destination and method selected.

Title and risk of loss for products pass to you upon delivery to the carrier. We are not responsible for shipping delays caused by the carrier, weather, customs, or events outside our control. If a package is lost or damaged in transit, contact us at kandykoatedkustoms99@gmail.com and we will work with you and the carrier to resolve the issue.

7. Returns, Refunds, and Exchanges

Because metal flake is a consumable material that is often opened and mixed once received, we accept returns only on unopened, unused products in their original packaging within 5 days of delivery. To start a return, contact us at kandykoatedkustoms99@gmail.com with your order number.

- Custom-mixed colors, custom orders, and special-order flake sizes are final sale and cannot be returned.

- Approved returns may be subject to a restocking fee.

- Return shipping costs are the customer's responsibility unless the product arrived damaged or was sent in error.

- Refunds are issued to the original payment method after we receive and inspect the returned product. Original shipping charges are non-refundable.

If your product arrives damaged or defective, contact us within 2 days of delivery with photos so we can make it right.

8. Product Use, Disclaimer, and Limitation of Liability Our products are sold for use by individuals who are knowledgeable in custom paint, coating, and finishing techniques. Proper handling, mixing ratios, application, ventilation, and safety equipment are the sole responsibility of the buyer.

Our products are sold "as is." To the fullest extent permitted by law, Kandy Koated Kustoms LLC disclaims all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose. We do not warrant that any product will achieve a particular finish, color match, or result, as outcomes depend on factors outside our control, including application technique and the other materials used.

To the fullest extent permitted by law, Kandy Koated Kustoms LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any damage to property, vehicles, or finished projects, arising out of the use or misuse of our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

Always follow all applicable safety data sheets (SDS), manufacturer guidance, and local regulations when handling and applying our products.

9. Intellectual Property

All content on the Site — including text, graphics, logos, images, product photography, and the "Kandy Koated Kustoms" name and marks — is the property of Kandy Koated Kustoms LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or use any of this content without our prior written permission.

10. User Conduct

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to submit false information, or to infringe the rights of others. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.
